What you insure

What business legal expenses insurance covers

Business legal expenses insurance pays for legal help when your business ends up in a dispute. The insurer's legal experts take the dispute on for you. Most policies also cover mediation and everyday legal advice, for example on staff or your premises. Policy terms and the insurer's letters are usually in Dutch. We translate them into your language.

It is not compulsory and it is not state legal aid.

It works alongside your business liability insurance. For lost turnover there is business interruption insurance. All three come together in the advice for your whole business.

Where it stops

What is usually not insured

Eight kinds of dispute fall outside most standard policies.

  1. Tax matters and disputes with the tax authority.
  2. Traffic violations.
  3. Bankruptcy.
  4. Disputes between business partners.
  5. Mergers and acquisitions.
  6. Disputes with parties abroad.
  7. Credit and subsidies.
  8. Trade names, trademarks, patents and copyright.

Timing has a hard edge too. An existing or looming dispute cannot be insured and a waiting period usually applies first.

Every policy draws these lines its own way. The line that surprises most owners is the border: work with foreign clients or suppliers and a dispute can fall outside standard cover. You get your policy read clause by clause, with a check on whether your insurer can add cover abroad. Look at the maximum the insurer pays towards external costs too. Some insurers handle claims in Dutch only. Check which language the legal help comes in.

Advice options

Advice sized to your question

Every route starts with the free call. You decide how to go on after that first conversation with your advisor.

Your advisor discusses what fits your situation in the first conversation. You then decide at your own pace.

What the first conversation covers · What's included

In the first conversation your advisor looks at how many covers and contracts go into the reading. The first call is always free. The insurance is then arranged or changed for you.

Insurance advice is provided by our associated company A&H Finance. They advise you and arrange the insurance. Your agreement for this advice is with them and they are responsible for the service. TaxSavers introduces you and is not a party to that agreement. Do you have a complaint about the advice? Raise it with them first. If you do not reach a solution together, you can take it to Kifid. They are registered there and have accepted binding advice, so a Kifid ruling binds them.

The difference

A policy thinks in modules. We start at your dispute.

A real dispute never asks which module it belongs to. We translate between the two: your work, your counterparties and the cover that fits.

Frequently asked

What business owners ask us

Short answers first, detail in the call. Your question missing? Ask Kim

Is business legal expenses insurance mandatory in the Netherlands?
No. It is a choice, not an obligation. Health insurance and motor insurance for a company car are compulsory. This cover is not, which is why fit matters more than price.
Is this the same as legal aid?
No. Legal aid is state-funded help for people who cannot afford a lawyer. A dispute about your business almost never qualifies. This insurance is private cover your business chooses itself.
Can I insure a dispute that has already started?
As a rule, no. Insurers exclude a dispute that already exists or is clearly on its way. That is exactly why cover is best arranged in calm weather.
Can I choose my own lawyer?
You have the right to choose your own lawyer in covered proceedings. How far that reaches differs per policy. You can have yours checked before you count on it.
Is there a waiting period?
Usually, yes. Most insurers apply a waiting period to new policies. It often does not apply when you switch from comparable cover. You can find out what applies to you.
Do you sell the insurance yourselves?
No. TaxSavers does not sell insurance. Insurance advice and arrangement take place outside TaxSavers, with our associated company. We explain what it means and stay beside you.
Will the insurer's lawyer handle my case in English?
Not always. Many insurers run their legal desk in Dutch only. You can find out the language of the legal help first.
Are you authorised to give mortgage and insurance advice?
TaxSavers advises on tax, not on mortgages, insurance or pensions. For those we work with A&H Finance, a trade name of New Business Group B.V. They hold the AFM licence (12017511) and they advise and arrange. We introduce you and take on the tax that follows. Ask us what that means for your corporate tax return.
